Can I claim against an uninsured driver?

Yes, you can claim against an uninsured driver, but it’ll work slightly differently. As the other party involved doesn’t have insurance for you to claim on, you’ll have to claim through The Motor Insurance Bureau (MIB).

The MIB was set up to ensure that any victim of an accident involving an uninsured driver would still be able to claim compensation. They operate just like an insurance company would – they will collect evidence and do what they can to establish liability.

What should I do if I’m hit by an uninsured driver?

You should try and collect as much information as possible after being involved in any road traffic accident, but it might be slightly more difficult when an uninsured driver is involved.

A driver that is uninsured is likely to be aware of this so, if they’re involved in an accident, will be unlikely to stop and exchange details with you. This makes is crucial that you gather as much information about the other vehicle as possible, such as the make / model and registration number if possible.

You should also get the details of any witnesses. They might have had a better view of the other vehicle and may have valuable information that will support your claim.

Any incident that has caused damaged to your car or personal injury gives you the right to ask for the other driver’s details – if they refuse then you should contact the police and your insurance provider as soon as possible.

The Motor Insurance Bureau is a company that’s funded by every motor insurance provider. Their role is to compensate victims of accidents in claims against uninsured and untraced drivers. 

You can claim for the same things you’re entitled to claim for in an accident with an insured driver. Our goal is to ensure you’re fully compensated for any damages you’ve incurred as a result of your accident with an uninsured driver.

It’s unlikely your uninsured driver claim will go to court, but we can’t say for certain. However, the majority of uninsured driver claims do get settled outside of court.

If you’re claiming for personal injury, you’ll get the expected three years to make your claim. But if you’re claiming for damage to your property, then you’ll get six years to make a claim.

You won’t be able to claim if you were a passenger in an accident and knew, or had reason to believe, that the driver was uninsured. The MIB doesn’t have to pay damages in situations where the claimant knew that the driver wasn’t insured at the time of the accident.

Firstly, to claim against an uninsured driver you need to have fully comprehensive car insurance. Secondly, you need to have proof that they were driving uninsured at the time of the accident.

If you meet both requirements, then the next step is to register for an account with the MIB and then complete an online application form. You should fill out all the relevant fields and include as much additional detail as you can about the accident to support your claim.

Once you’ve completed the claim form and liability has been admitted, we’ll need to provide evidence of your injury so that the MIB can calculate how much compensation you’re entitled to.
